The source code for sxitch is publicly available under the Apache 2.0 License at https://github.com/MystikoLab/sxitch. The Apache 2.0 license governs your use of the source code itself.
The pre-built binary distributed through this website and your purchased license key remain subject to the terms of this EULA. Nothing in this Agreement limits your rights under the Apache 2.0 License with respect to the source code.
By downloading, installing, activating, or using sxitch ("the Software"), you ("User" or "Licensee") agree to be bound by this End User License Agreement ("Agreement").
If you do not agree to these terms, do not install or use the Software.
The Developer offers the following license tiers. Your purchased license determines how many devices you may activate the Software on simultaneously. Activations are tied to your license key.

Subject to the terms of this Agreement, the Developer grants you a personal, non-exclusive, non-transferable, limited license to install and use the Software on the number of devices permitted by your purchased license tier, solely for your personal or internal business productivity purposes.
You may not sell, sublicense, rent, lease, lend, or otherwise transfer your license or license key to any third party.
You agree that you will not, and will not permit any third party to, do any of the following:
Violation of any restriction may result in immediate termination of your license without refund.
The pre-built binary of the Software is licensed, not sold. The Developer retains all right, title, and interest in and to the Software binary, including all intellectual property rights. This Agreement does not grant you any ownership rights in the binary.
The source code is licensed separately under the Apache 2.0 License and is governed by the terms of that license. In the event of a conflict between the Apache 2.0 License and this Agreement, the Apache 2.0 License prevails with respect to the source code.
The Developer may, at their sole discretion, provide updates, bug fixes, patches, or new versions of the Software. Updates are provided at the Developer's discretion and are not guaranteed.
Nothing in this Agreement obligates the Developer to provide any specific update, feature, or version. Any updates provided will be subject to the terms of this Agreement unless accompanied by a new agreement.
The Developer offers a 7-day money-back guarantee from the date of purchase.
Nothing in this clause limits any rights you may have under applicable Singapore consumer protection legislation, including rights in respect of defective products.
To the maximum extent permitted by applicable law, the Software is provided "as is" and "as available", without warranty of any kind.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of profits, revenue, data, business, or goodwill; cost of substitute goods or services; damages from unauthorized access to your data; or any other damages of any kind - even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the Developer's total cumulative liability to you for any claims arising out of or related to this Agreement or the Software shall not exceed the amount you actually paid for your license.
You acknowledge that Singapore's Unfair Contract Terms Act may limit the enforceability of certain exclusions above in some circumstances. The limitations in this section apply to the fullest extent permissible under Singapore law.
sxitch operates entirely on-device. The Software does not collect, transmit, store, or share any personal data. No account creation is required. No telemetry is sent.

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically and without notice if you breach any term of this Agreement, including but not limited to the restrictions in Section 3.
Upon termination, you must:
The Developer may also terminate this Agreement at any time for any reason, with or without notice, subject to the refund policy in Section 6.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.
Any dispute arising out of or in connection with this Agreement shall first be attempted to be resolved through good-faith negotiation between the parties.
If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore.
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and the Developer with respect to the Software and supersedes all prior or contemporaneous understandings, communications, or agreements, written or oral, regarding its subject matter.
The Developer reserves the right to update this Agreement at any time. Continued use of the Software after any changes constitutes acceptance of the new terms. Material changes will be communicated via email or Discord.
